Greek law governing Personal Injury
The Personal Injury system in Greece
Greece is a civil law jurisdiction based on the constitution, and, international conventions and treaties. Fault-based liability is the rule under Greek law, which is similar to Ireland. Again, as in Ireland, the victim/claimant has the burden to prove the defendant’s negligence or intent.
Civil liability insurance is not always mandatory under Greek Law, and, this may cause serious problems for the victims of personal injury in cases, where the wrongdoer has no funds to compensate the injured party.
Liability for personal injuries is primarily based on the “Wrongful Acts” provisions of the Hellenic Civil Code, on the general principals of law, and on national and international legislation relating to specific rulings such as the EU Motor Insurance Directives, the Montréal Convention, Athens Convention and International transport conventions.
